Clerical error it happens especially if dealer is registering a batch of vehicles on the day, it does happen
On mine the gross weight is less then what the vin says.

Engine speed 3000, your van must be slow

It get even more confusing when you get pulled over in a Ford Ka & get a ticket for having a towbar fitted on it
(Ka's are not allowed to tow anything now)

Bloody EU/EC directives

I emailed Andy on the V5 issue .....

to me

I do apologies when I went onto the system yesterday I had inputted the incorrect spec of your vehicle. Having now looked at the correct spec I can confirm that the details on your logbook are correct.

My (ex) VOSA expert said that if any prosecution was to come from exceeding the manufacturers recommended towing capacity then it would need to be done under C&U reg 100 which seems to be a general regulation covering safety ................

http://www.legislation.gov.uk/uksi/1986 ... n/100/made
Maintenance and use of vehicle so as not to be a danger, etc
100.—(1) A motor vehicle, every trailer drawn thereby and all parts and accessories of such vehicle and trailer shall at all times be in such condition, and the number of passengers carried by such vehicle or trailer, the manner in which any passengers are carried in or on such vehicle or trailer, and the weight, distribution, packing and adjustment of the load of such vehicle or trailer shall at all times be such, that no danger is caused or is likely to be caused to any person in or on the vehicle or trailer or on a road.

Provided that the provisions of this regulation with regard to the number of passengers carried shall not apply to a vehicle to which the Public Service Vehicles (Carrying Capacity) Regulations 1984 apply.

(2) The load carried by a motor vehicle or trailer shall at all times be so secured, if necessary by physical restraint other than its own weight, and be in such a position, that neither danger nor nuisance is likely to be caused to any person or property by reason of the load or any part thereof falling or being blown from the vehicle or by reason of any other movement of the load or any part thereof in relation to the vehicle.

(3) No motor vehicle or trailer shall be used for any purpose for which it is so unsuitable as to cause or be likely to cause danger or nuisance to any person in or on the vehicle or trailer or on a road.

Don't see anything confusing now.

Vosa states in your email the manufacturer dictates the towing limit. And Ford has said that's 1200KG.

If wanting a specific answer to something then asking an authority like VOSA needs the question to be specific

My question to my expert was ....

If a B+E towing combination was found to be within all plated weight limits but exceeded the manufacturers recommended towing capacity then what law could the driver be prosecuted under ?

I assume you mean to tow a 1060 trailer/caravan ?

You could do this on a B licence - no B+E ....
GVW 2340
GTW 3140
Kerbweight 1440
Towing capacity 1200
Trailer MAM/caravan MPTLM 1160

If the caravan/trailer was loaded to its full capacity of 1160 then the max the transit could weigh is 1980 (1160+1980=3140)

Check weight distribution

Remember to put the heavier load in the back of van NOT caravan. this will make sure whole outfit is level.
BUT in doing this you will reduce the weight on what you can tow !

As connect owners know, they don't sit level when unloaded

I Know on my connect the unladed rear axle weight is ONLY 580kg !! (label on rear of van gives the unladen & MAX laden weight of rear axle.)

Image

Yes it is very light when unloaded. If a loaded trailer or caravan weighing 1000kg was attached to it. I could stand on the back of trailer/caravan & it would literally lift back of van up of the road ! :(
