Cops use the being in charge option when they do not get the person actually driving but it becomes reasonable to assume that they will be
It would be unreasonable not to have such a law because if it could only be used if the engine was on when the person in the driving or passenger seat then they could be sat watching them for hours just sat in the front seat with engine off waiting for the cops to bog off
