Double Cab-in-van VAT reclaim ?

Postby chrisabraham » Tue Mar 01, 2016 1:54 pm

Hi all...my first post as a (nearly) ford owner !

im vAT registered and looking to by a

290 L1 H1 double cab in van 2.2 tdci 155ps NON start stop from new next week. I didn't think anything of it but when i checked the VAT situation for such vans it appears extremely grey...

Does anyone know definitively if Vat can be reclaimed on this vehicle?

http://www.chandlerandgeorges.co.uk/dat ... &FID=15991

http://bishopfleming.co.uk/is-it-a-car- ... combi-van/

the payload for the NON start stop seems to be right on the limit so if passengers are added does that reduce the payload and so take it under? also its not clear on some sites whether you need to satisfy both the payload and space criteria or either or?

I have an accountant who is extremely cautious on such matters! Its all very well to say just do it but there could be implications later on if HMRC don't agree. The van is not listed on the HMRC approved list but 'seems' to satisfy the criteria.

Has anyone had any similar issues or been able to find the actual answer?

many thanks for your help

Chris

Leasing it may be the answer, and claim back the VAT on the payments

A friend was told that he'd need to buy a 310/330 DCiV for it to qualify.

Isn't it 928kg gross payload?

Ah, so that's why it needs to be a 310

As a general rule, HMRC accepts that a double cab pick-up with a payload of 1 tonne (1,000kg) or over is a van for benefit purposes. The 1 tonne rule applies only to double cab pick-ups, not to any other vehicle.

Correct.....maybe......well that was what I was told......best bet is to phone HMRC as it's an expensive mistake to make.

I'm sure that I was told the same some time ago, but must admit that I had forgotten

I believe the 290 L1 double cab in van without stop start gross payload is 1000 BUT latest advice I've had from an online solicitor states

Where you have a second row of seats and/or rear side windows, plus a goods area, it becomes a mixed purpose vehicle and the 1,000kg payload rule cuts in. The payload limit should not normally include the passengers. If you cannot carry a metric tonne with a full compliment of passengers then you are on sticky ground.

so doesn't look good...
