How many passengers can I carry legally?

Postby flygrip » Sun Oct 04, 2009 12:50 pm

Hi, everyone.

Can anyone point me at the right direction on this one?

Driver seatwith seat belts(carrying 1) + Bench passenger seat with seat belts(2)

Solid bulkhead, 1 side loading door, aka Standard box van.

Can I carry any body legally at the back(i.e. loading area) occasionally for a short trip without bolt a proper seat to the floor?

If I put a minibus seat in there, do I have to fit the seat belt aswell?

Btw, the back of the police does not have any proper seating in the cage(you know what i mean), if they can carry some doggy character like that, why cant we?

Thanks in advance

Tony

I think you can carry up to 8 people legally as long as they are properly seated with belts, someone on here might know more in detail

Without proper seats with belt and windows only three in the cab, as your insurance will be void, and how would you feel if some one in the back was badly hurt or worse if you crashed due to not been strapped in properly.

Thanks for your fast reply.

I dont want anyone get hurt or injured or break any laws. That is why I am posting the question here.

But what if you had a accident in the back of police van? with no windows and no seat belts?

It's not legal or particually safe to carry people in the back of vans who aren't in seats and with seatbelts on (not saying it doesn't happen though  :P )

I'm not an expert but there will be various exemptions to the law ie for the police to carry prisoners and public service busses (which you're allowed to stand in!)

Insurance will be the problem here :?

It's illegal to carry uninsured passengers in any vehicle, and unless the van has been properly converted to carry passengers in the back, and notified to your insurance company, then you can't do it legally :(

If I remember rightly, you dont have to have belts on side facing seats in crew buses... but I think that is for purpose built crew buses. I drove one for a few years.
Although I havent seen one in a modern crewbus for a few years

It's the other way round. You can carry up to 8 passengers on your driving license (in general) - that means 9 people including the driver.

BUT - and this is valid in the UK ONLY :!: :!: If you had entitlement to drive cars prior to 1 January 1997 you can drive a minibus provided you are 21 or over and the minibus has a maximum of 17 seats including the driver's seat and is not being used for hire or reward. :!:

Having said that - to drive a minibus which has nine or more passenger seats for hire or reward you will normally need passenger carrying vehicle entitlement (PCV). To obtain this you must meet higher medical standards and take a further driving test. However, if you drive a minibus for an organisation under the minibus or community bus permit scheme you will not need to have the higher PCV entitlements.. You can NOT carry more than 8 passengers OUTSIDE of the UK AT ALL :!:

All the details are available here.

I was looking into it, as my bus is registered as a 12 seater (and I thought I can only drive 9 seaters on my license...).

The insurance is different issue. If your van is registered as a 3 seater and you add seats to the back (now forgetting all the "stay alive" risks related to it) you instantly become illegal. Because you just "modified" your vehicle and your insurance is invalid as someone said before me.

My friend builder did solved the situation with fixing and plating rails for triple bus seat in the rear and registered the vehicle as 6 seater. Insurance is fine with it as long as the seats (in this case rails) were bolted in and plated properly (certificate needed). Now he has the option of putting the bus triple seat in when needed (it has got the seatbelts on it). Not sure what else was needed though... :?

Where its bolted thru there needs to be plates to stop the bolts pulling thru the floor
