so what would be the best way about threaten them with ombudsman?

shall i just turn around and say if you cant sort it out i will be going to the ombudsman?

something along them lines yes..they are like a health & safety officer or environmental health,,no-one wants them b*stards lookin into your business so normally it frightens them into being a bit more co-operative..trading standards may also be able to help too

HI Gurj, can we all pop down from Birmingham and try your moms cooking?

Sorry to read about your mishap, just bear in mind a few things.

The insurance assessor works for them, not you.
They want to make money, that's why they are in business.
You do not have to take their first offer, or second.
The more facts you give them, re Tddi etc the better.
Ignore what it says on your logbook, DVLA do frequently screw up.
Get evereything THAT'S EVERYTHING in writing. Verbal is no good.

And the best way to put the shits up them as a last resort, is to ask politely, " woud you by any chance have the number and address for The Insurance Ombudsman please?". Don't just threaten them, get the details off them. Instant arsehole twitching!
Every person you speak to, ask for their name, operator number, and tell them that you are logging the call at x o'clock.

There are some sort of rules to using the ombudsman. He is the last person to get involved when a resolution can't be found. He wont be interested until the insurance company put it writing that this is their final offer. You have to be seen to be exploring all avenues, so your probably a couple of letters away from using the ombudsman line yet.

You seem to have put together a really good case so far. Continue to strongly disagree with their offers, they have a duty to their shareholders to save as much money as possible so will always try and go in low and then climb to an acceptable level.

Counter all of their arguments with solid evidence to back it up. Use instances of them acting before consultation, like sending the recovery guy round before an agreement has been settled. You could argue that was harrassing you in to accepting an offer you weren't happy with. Once you get to the stage where they are making a full and final offer, then go for a last letter stating you will take your case to the ombudsman.

The insurance ombudsman is actually the financial ombudsman their web site is http://www.financial-ombudsman.org.uk/p ... sputes.htm

there is a lot of useful information on there that will help you with your negotiations before you use their service. By the way its free to use and the ombudsmans decision is final. If you want any assistance with drafting the letters give me a shout, I've had a bit of experience threatening corporates and winning big time, threatened to sue my bank and got them to cough up £13k...no legal representation did it all myself....they settled on the steps of the court.

This is exactly why my first call would have been to the Legal dept of the FSB (Federation for Small Businesses), befgore I accepted or disagreed with any offer. My mate calls them all the time even for his non business legal issues. At £100 per year it's good value for a solicitor on call 24/7 is it not? For all you self employed guys, get on board can you afford not to?

Got an update today when i received a letter through the post from the insurance company!!

they have now decided to increase the offer by £140.00..................................................... :(

making it £1740.00 in total still not stating if that is plus vat or not. which ever way it still dose not come close to what the actual market value of the van is.

So back to writing out another letter now. Will keep the thread updated with and progress.

No Geoff i am not vat registered Which i would thought meant i get the vat back as i have paid the vat and not claimed it??

My old man is vat registered but the van is on my name and my name on the insurance policy.

I cant believe it they increased the offer by £140.00 and thought i will accept it! :evil:

sorry to hear of your hassles with the insurance a***holes, fight the f****** tooth & nail, dont back down and if possible hold out &have patience, coz these dicks expect you to accept their first offer, if you can , hang off , & fight them all the way. good luck

second letter to CIS

Dear Sir/Madam

I am writing this letter in regards to the ’’increased’’ settlement offer I received for my vehicle, (Reg X992 DLE). Which you have stated is beyond economical repair.

You have increased the offer by £175.00 making the total of the settlement offer £1775.00. It has still not been confirmed if this price Inc or Ex vat. Which ever way I still think the offer is no where near acceptable. As the average price for the 10 adverts I sent over to you for similar vans like the one I own, came to around £3200.00.

The settlement offer which has been offered to me now is still around £1100.00 lower. Even if it is plus vat.

I am kindly requesting for this matter to be looked in to again. In hope that you can offer me a settlement offer which is a little more acceptable.



o be honest i know i wont be getting anythink like 3.2k and i am not expecting that. But i definitely wont be accepting anything lower then 2.5k all in!

Which i think is a little more acceptable.


Also they say the cost of buying the van back is 30% :(

seriously confused!!

a serious amount of bad luck lately. Taken my work on to ebay as i was made redundant early this year. The, F*K bags have suspended my account as they think i own my brothers account which had been suspended 3 odd years ago. so any source of income i had has stopped! :(
:cry: They have done this several times and i have proved to them that we are 2 different people and i dont own that account. But this time around they just dont seem to want to know! :(

£1530.00 mortgage every month, lodas of bills need a new van, need to break up with lass :(
