Hi Folks,

I have just found out something very specific and with a great impact for business to business buyers.

I looked for it here, but couldn't find it, have I missed it?

In a nutshell, if you are buying anything from a business for (or primarily for) your business, the seller has the right to restrict your rights by stating it in their Terms and Conditions.

The law has made an assumption that because you, the buyer, are in business, that you are very knowledgeable about whatever you buy for your business, so it is assumed that you know how to interpret the quality and functionality of what you are buying before you buy. And your rights to return it or have any redress about a fault with it can be removed in the Terms and Conditions of sale.

I have just found this out to my cost. I am a gardener, not a mechanic or coachworker. I just bought a van from a van dealer and like a complete rookie just trusted him that all would be good. It wasn't. It soon came to light that the van was riddled with problems, and even the MOT he obtained was bogus (I mean the tester himself had falsified it). I started contacting him the day after I took the van home, and he has been completely unhelpful. He never answered any emails (although he told me on the phone that he had read them all and he would answer). This dealer is trading as D M Vans, Great Missenden - AVOID! He is also affiliated to Chesham Vans, and his actual company name at Companies House is KARS.CO.UK LIMITED.

It turns out that he has not removed all my rights in his Terms and Conditions, so I have a legal leg to stand on.

Moderators, can you include this information properly composed as a sticky in this section? If I had read about this, and had my head screwed on, I could have avoided so much bother, and expense.

Oh My Gosh C8XY!

I am so glad too that you saw this!!! They are complete B£*%£$!S! Neither the son who runs DM Vans nor Asrar Ahmed the director gave a flying £$%&^£ about ripping me off!!!

In all cases, no matter what, CAVEAT EMPTOR! Get a trusted mechanic to check out the van thoroughly before purchase, no matter what. NOTHING IS MORE HASSLE THAN BEING RIPPED OFF. I feel like such a chump, but this will never happen to me again.

I pursued my case against them, but on solicitor's advice I simply will probably not have enough on my side by law. The whole thing became so complicated, and for like 2 or 3 grand it's nothing in the world of law.

It's a nightmare, I would do anything I could to guide anyone away from so much wasted time and money. The only thing I've got left is to leave them a calm, scathing, accurate Google review ("revenge is best served cold").

Please, let us know how you get on with your purchase?

Hi Soldier,

I'm sorry to hear you have got yourself wrapped up with these outright crooks. How did it happen? Did you research them before you bought the vehicle?

I am very surprised they are even still trading, they were fined £60,000 earlier this year for not complying with green belt regulations.

First question - did you pay by credit or debit card?

Is there a time limit beyond which a new comment on a post does not bump it up? Is it written somewhere in the FAQs or somewhere else?

Nope, just to expand on what Mike said, any new post will bump an old thread to the top, except if they haven't been approved, because they're still invisible, except to admins.

It's always advisable for a new member to start a new topic, or at least post in a current thread, but ideally, in the welcome section, which is monitored for new posts several times a day :idea:
It's in the "new members read" section that no-one reads :lol:
