Engine Failure - Oil Filter Loose

Postby Amberley » Thu Aug 28, 2008 8:17 pm

Hi all,

I have had a Transit Connect from new and its now 4 and a half years old with 117,000 on clock. We use it for our cleaning company.

It was always serviced by Ford until its last service at 105,000 miles - and then a local fast service depot serviced it. Two months ago now the driver was driving the vehicle and the oil light came on. The driver stopped. A Roadside Breakdown company were called out - they said the filter was loose and the oil filter seal was worn. He tightened it up - with his hand and put new oil into engine. Then he put on the sheet that the oil filter needed to be changed the next day.

Our driver drove off and ten miles down the road the engine made a loud noise and he stopped. He then recovered the vehicle to Ford Garage who said the engine needed replacing. The van has been in the Ford garage yard since.

We are looking at taking legal action against the servicing garage, but may look at taking action against the roadside breakdown company.

Does anyone know at what pressure the oil light comes on at? Would the engine have failed at this point?

Would an oil filter come loose under normal circumstances.

Speaking to a mechanic friend he thinks the pressure light only comes on at a very low pressure and the engine would have failed then. The reason the roadside repair guy didn't notice it was because the engine was cold at time he started and when the engine got hot then the fault became apparent. Is this correct?

Who would you sue?

Any advice would be much appreciated.

Regards

Tim

just buy another engine, you have no chance suing anyone, maybe you should have stayed with the ford servicing, it was ok for a 100k or so !! why did you stray ?? money saving no doubt, but did it pay ??? oh and welcome :D

Hi thanks,

No we had the local depot because of convenience - I've learnt my lesson ! :-). Does anyone know how much a new T200 engine would cost and where would I get one. Ford have quoted £3000 approx with a years guarantee.

Since we have been looking into whether we have a case or not we have heard that a friend of a friend had the exact same problem with the same company, in a different town, and the depot paid for the new engine.

I have been told by a mechanic that you can have oil warning light or an oil pressure warning light. The oil pressure warning lights are set to go off at a low pressure as if they are set too high then they would go off when you say were breaking after coming off the motorway. So usually light on means engine fail.

The depot customer service guy is trying to break my case to bits, and put doubt in my mind, before I fill the forms and take the legal action. He has told me that engine failure is not always the case.

you'll need to prove legal negligence which is all but impossible - put the legal fees (which you won't be able to recover) towards the repair - sorry to be negative but sued and been sued in the past - you'll get nowhere :(

wont get anywhere with the roadside recovery agent..As in the breakdown clause sheet/damage report there will be a clause saying the fitter/agent wont be held liable for any damage done to vehicle...I used to do recovery 24-7 for myself a few years ago and i must have had that tried several times..The garage will also most proberbly have the same on either the back of the recipt or somewhere on a sign in reception saying they wont be liable or something simalar..
As someone already said should have stayed with who u was with already.
Get a fixed quote from ford for the engine cost as it could go up from the £3000 quoted. They know how long it takes to do these engines ..
