I’m considering moving to a ground floor flat in a fairly new purpose built complex
They’re Leashold
The Lease of Part, Tenants Covenants, states “Not to park Caravans, Trailers, Boats or Commercial Vehicles on the Estate”
Has anyone else been in this situation?
Is there an argument that would allow me to park my Custom in the allocated bay?
Mine is a 2017 SWB LR Limited in Moondust Silver with no sign writing
I use the Custom because I’m disabled and it’s easier to get in & out than a car
I have a Blue Disabilty Badge
I’d appreciate it if anyone can suggest an argument that has worked for them

Ask the covenant holder, imo there’s no point causing a dispute when a simple question can be asked.

As suggested, I would ask. You must have a case surely if it is not sign written and you use it privately. Our Sport is insured as a private vehicle with Aviva. Perhaps you ins cert will help to show it is not used as a commercial vehicle.

It is a commercial vehicle, regardless of use, writing, stickers or a Sunday sport on the dash.

Doesn't matter what it's insured as, whether or not it has Windows etc. Unless been officially changed on the log book, it's a commercial vehicle

Obviously a commercial vehicle but he's not dealing with the DVLA or the Police here. I think it would be worth highlighting that he requires it due to disability and prove it's not used for commercial purposes. Surely worth a try when he speaks to the property factor. It's not like he's trying to take the piss with an XLWB Sprinter.

As you say, I would think that the freeholder is simply trying to stop tenants bringing home their large, signwritten, company commercials.

If the OP had the Tourneo version of the Custom, then that would be OK, as it's definitely not a commercial vehicle, so it may be that an allowance would be made in this case, if he asks nicely :mrgreen:

What if an existing house holder objects to a van being parked there? The covenant conditions may have had an influence on their purchase. They’d be quite within their rights to object.

Many thanks for all the contributions and advice
If I buy the flat I’m aware of the covenant, and I can plead my case with the freeholder or management company
They can only say no, and hey ho I might get lucky
I might buy some sticky on “Toureno” badges and hope they don’t know the difference

Sometimes things only become a problem if you bring attention to them??

I bet lots of people haven't read their property deeds for covenants about caravans, vans, sat dishes etc etc at the front of their properties and go ahead and have them there.

My 2p yes its a commercial vehicle but last 2 time we have taken my DCiV ( double door ) to France on 1 eurotunel and P&O we have done this as high car rather than commercial .

Mrs Agriv8 rang them up to confirm the jist was :-

we are going on Holiday
Its insured as Family car
It has 4 Door
it has 6 seats
It has a bl**dy huge boot for bringing the wine back ay the end of our two weeks.

quite a saving as high car over comercial.

PS re the opening post my Mate could not park his works van on his drive ( HUGE merc Sprinter ) but the curtain twitcher on his street did not complain about the VW transporter two doors away !

I suppose to some people size really does matter!
I might try the argument” it’s really just a vehicle with a huge boot” ( for carrying wine)

Try ringing em for a quote p and o phone staff usually really good.

The 4 doors and windows seemed to be the clincher.

I think the rational is it footprint and height ain’t that much different to say a land rover disco or rangrover.

It was sister in law who rang and booked as high car there on who put us onto it done 3 trips before this and paid commercial price and they won’t let you use the discount vouchers / codes.

Other good tip Tesco vouchers £10 is tripled to 30 for euro tunnel
